The House of Commons Justice Committee has launched a new inquiry into the processing of Probate applications by HMCTS (HM Court and Tribunals Service) amid concerns that delays are at their highest rate since 2019. The Consultation closes on 22 January 2024. The average time taken for HMCTS to process an application for Probate is around 16 weeks (as at December 2023). Where Inheritance Tax is payable or a paper application is necessary, the application will take significantly longer.
